Liability In San Francisco Balcony Fall Accidents At The Chase Center
Falls remain one of the leading causes of injury and death in the United States. According to the Centers For Disease Control, “Each year, millions of older people—those 65 and older—fall. In fact, more than one out of four older people falls each year, but less than half tell their doctor. Falling once doubles your chances of falling again.” Victims of fall accidents tend to suffer very serious and costly injuries including:
- Broken bones
- Head injuries
- Organ damage
Depending on the specific facts of any case there could be numerous sources of liability for a balcony fall. According to California Civil Code 1714, property owners have a legal responsibility to maintain their premises in a reasonably safe condition. When a property owner fails to maintain their premises in a reasonably safe condition they can be held liable through a civil claim. For example, if a balcony’s railing was not sufficiently high this could lead someone to fall. There are a number of steps that should be taken after being injured in an accident.
- Victims should seek medical care.
- Eye witnesses should be interviewed.
- An investigation should be conducted.
- A premises liability attorney should be contacted.
Any person that is injured by someone that fell from a balcony may be able to seek justice through a bodily injury claim. Damages can help cover lost wages, medical bills and pain and suffering. A premises liability attorney can examine all of the unique facts of your case and let you know what your legal options are. There are, however, statute of limitations associated with civil claims.
