Liability In Long Beach Pedestrian Accidents

Thousands of pedestrians are killed or seriously injured every year in pedestrian accidents. According to the Centers for Disease Control, “In 2017, 5,977 pedestrians were killed in traffic crashes in the United States. That’s about one death every 88 minutes.” Los Angeles county, in particular, has one of the highest instances of pedestrian collisions in the United States. There are a number of factors that could potentially contribute to a car accident including:

  • Speeding
  • Distracted driving
  • Driver fatigue
  • Inclement weather

Drivers have a legal responsibility to exercise due care in order to avoid hitting pedestrians. According to California Vehicle Code 21950, “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection, except as otherwise provided in this chapter.” When a driver fails to exercise due care and hits a pedestrian they could be held liable in the event of a collision. Victims of pedestrian accidents tend to suffer very serious and costly injuries including:

  • Broken bones
  • Lacerations
  • Head injuries
  • PTSD

The family of any victim that died in a car accident may be able to seek justice through a wrongful death claim. Damages can help cover lost wages, medical bills and pain and suffering. However, insurance companies will often fight hard to deny liability for any accident. A wrongful death attorney can examine all of the unique facts of your case and let you know what your legal options are.
