Liability In Felton Car Accidents With Falling Trees

Accidents involving falling trees may seem like freak occurrences, but they kill nearly 100 people per year. Thousands more and left with serious and debilitating injuries. There are a number of different factors that could contribute to accidents with falling trees. For example, a fungus could make a tree unstable. Old age or damage from insects could do the same. People who are hit by tree branches or falling trees could suffer a number of injuries including:

  • Broken bones
  • Lacerations
  • Head injuries
  • Spinal cord injuries
  • Organ damage

Depending on the specific facts of any case, a city or municipal entity could be held liable for someone being killed by a falling tree. Cities and municipal entities have a legal responsibility to maintain their premises in a reasonably safe condition. This includes taking measures to monitor the trees on their property. Cities should periodically conduct studies to determine if the trees on their property are likely to fall over.

When a city is aware of a tree on their property that is in a dangerous condition they must take action. This includes trimming branches or removing the tree all-together. If a city knew (or should have known) that a tree was in a dangerous condition and failed to act, that city could face civil liability if someone is injured or killed. There are a number of steps that should be taken after any accident involving a falling tree.

  • Photos of the accident site should be taken.
  • Surveillance footage should be sought.
  • Records of tree inspections should be sought.
  • A full, independent investigation should be conducted.

The family of any victim that died in an accident may be able to seek justice through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. In order to win any civil claim plaintiffs will typically have to demonstrate negligence. A wrongful death attorney can examine all of the facts of your case and let you know what your legal options are.
