CYPRESS, CA (September 30, 2022) – Hannah Star Esser, 20, is facing murder charges after striking and killing Luis Anthony Victor, 43, with her vehicle as she claimed he was trying to kill a cat.
According to the NY Post, the collision occurred on September 25 at around 8:20 p.m. when Esser believed that Victor was trying to run over a cat. Her observation led to both Esser and Victor to step out of their vehicles and argue.
Esser eventually got back into her vehicle, completed a 3-point turn, and sped toward Victor when she struck and killed him. Prosecutors say that Victor was thrown onto the hood of Esser’s car and flipped several times before landing on the street where he died.
The events leading up to the killing might have been recorded by Esser on her phone.
If convicted, she faces 25 years to life.
Liability In Cypress Pedestrian Accidents
Thousands of pedestrians are killed or seriously injured every year in pedestrian accidents. According to the Centers for Disease Control, “An estimated 137,000 pedestrians were treated in emergency departments for nonfatal crash-related injuries in 2017. Per trip, pedestrians are 1.5 times more likely than passenger vehicle occupants to be killed in a car crash.” There are a number of factors that could lead to a pedestrian collision including:
- Speeding
- Drunk driving
- Driver distraction
- Inclement weather
All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. The family of any victim that died in a pedestrian collision may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. A wrongful death attorney can examine all of the facts of your case and let you know what your legal options are.
