Man Fatally Struck By Train In Fontana

1 person injured after Caltrain hits 3 cars in Burlingame

Fontana, CA (November 8, 2023) A male pedestrian was hit and killed by a BNSF (Burlington Northern Santa Fe Corporation) train on November 2nd in Fontana, according to authorities. The Fontana Police Department stated that the accident occurred around 9:17 p.m. as the train approached Sierra Avenue.

Fontana Police Department Public Information Officer Steve Reed told Fontana Harold News that the train was heading east on the railroad tracks when the collision occurred. The conductor actually saw the man on the railroad tracks and used the train’s horn to alert the pedestrian. He slammed on the emergency brakes in an attempt to stop, as well, according to Reed.

His efforts were futile, though. The pedestrian didn’t move, but remained on the tracks until the train hit him.

Emergency crews arrived at the scene only to find the man deceased. He was pronounced dead at the scene by officials and the coroner was called. Once the coroner was finished at the scene, the pedestrian’s body was transported to the morgue until the next of kin could be notified.

The train conductor was cooperative with authorities and no one knows why the man didn’t get off the tracks when the train was coming. The San Bernardino Sheriff’s Division and the BNSF Police are leading the investigation to figure out what exactly happened and why the pedestrian didn’t get out of the train’s way.

Liability In Fontana Pedestrian Accidents

Thousands of pedestrians are killed or seriously injured every year in pedestrian accidents. According to the Centers for Disease Control, “An estimated 137,000 pedestrians were treated in emergency departments for nonfatal crash-related injuries in 2017. Per trip, pedestrians are 1.5 times more likely than passenger vehicle occupants to be killed in a car crash.” There are a number of factors that could lead to a pedestrian collision including:

         -Speeding

         -Drunk driving

         -Driver distraction

        -Inclement weather

All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. The family of any victim that died in a pedestrian collision may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. A wrongful death attorney can examine all of the factors of your case and let you know what your legal options are.
