James Smith run over and killed by tow truck in Dallas

National City, CA (August 23, 2023) A pedestrian was struck by an SUV on Tuesday before the vehicle crashed into a tire store in National City. The National City Police Department said the pedestrian was seriously injured in the accident.

A woman was driving a Toyota RAV-4 when, for reasons unknown, she lost control. It all happened in the 1300 block of East Plaza Boulevard, between Palm Avenue and Highland Avenue, around 3:30 p.m. The vehicle hit a man who was walking along the road, before crashing into a business.

National City Police Department Sgt. Paul Hernandez said the woman crashed through the front windows of a Discount Tire store and came to a stop inside the store.

Emergency personnel arrived at the scene and found the pedestrian bleeding heavily from a severe arm injury. Sgt. Hernandez said there was a thick blood trail from the Discount Tire store to a nearby Starbucks, where the injured pedestrian collapsed.

A good Samaritan, Nick James, saw the injured pedestrian and ran to his rescue. He managed to calm the pedestrian and then applied a tourniquet from a bandanna to the man’s injured arm. James said he has no prior medical training, but jumped into action in a time of need. He was taken to a local hospital for treatment.

Authorities said the driver of the vehicle was taken to the hospital with minor injuries and drugs and alcohol do not seem to be a factor in this accident.

Liability In National City Pedestrian Accidents

Thousands of pedestrians are killed or seriously injured every year in pedestrian accidents. According to the Centers for Disease Control, “An estimated 137,000 pedestrians were treated in emergency departments for nonfatal crash-related injuries in 2017. Per trip, pedestrians are 1.5 times more likely than passenger vehicle occupants to be killed in a car crash.” There are a number of factors that could lead to a pedestrian collision including:

  • Speeding
  • Drunk driving
  • Driver distraction
  • Inclement weather

All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. The family of any victim that died in a pedestrian collision may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. A wrongful death attorney can examine all of the facts of your case and let you know what your legal options are.
