Pedestrian killed by SUV in East San Jose, marking third traffic death in a single day in the city

SAN JOSE, CA (June 30, 2022) – A woman was struck and killed by an SUV in East San Jose on Tuesday according to East Bay Times, making it the third traffic fatality for that day.

It’s reported that the slain woman makes San Jose’s pedestrian collision death count 22 for 2022, which is one shy of 2021’s 23 fatalities.

The San Jose Police Department says that the accident occurred around 5 p.m. near the intersection of Leeward Drive and Arden Way. The woman was crossing Leeward Drive in a designated crosswalk when a person in a 2005 Nissan SUV struck her.

The driver did stop at the scene and waited for emergency response to arrive. The pedestrian, whose identity is being withheld at this time, was taken to the hospital with critical injuries. She succumbed to those injuries on Wednesday morning.

Earlier Tuesday morning, a woman was killed by a hit-and-run driver near South Jackson and Kammerer avenues, and later the same morning a man died after crashing into a tree.

Liability In San Jose Pedestrian Accidents

Thousands of pedestrians are killed or seriously injured every year in pedestrian accidents. According to the Centers for Disease Control, “An estimated 137,000 pedestrians were treated in emergency departments for nonfatal crash-related injuries in 2017. Per trip, pedestrians are 1.5 times more likely than passenger vehicle occupants to be killed in a car crash.” There are a number of factors that could lead to a pedestrian collision including:

  • Speeding
  • Drunk driving
  • Driver distraction
  • Inclement weather

All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. The family of any victim that died in a pedestrian collision may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. A wrongful death attorney can examine all of the facts of your case and let you know what your legal options are.
